Start a trucking company in Pennsylvania

UPDATED JUL 2026 · DATA RETRIEVED JUL 2026
THE SHORT ANSWER

To start a trucking company in Pennsylvania you'll file a Certificate of Organization with the Department of State ($125) and get a free EIN from the IRS. An intrastate property carrier also needs a Certificate of Public Convenience from the Public Utility Commission, a $100 filing fee plus a safety fitness review, before hauling loads that start and end in the state. Federal interstate operating authority (MC number, $300) applies for freight crossing state lines and takes three to four weeks to activate. Total one-time state LLC filing: ~$125 and 5–15 business days.

Pennsylvania backs its Public Utility Commission certificate with a real penalty attached: operating an intrastate load without authority carries a fine of up to $1,000 per violation, separate from anything the federal side enforces. The certificate number has to be lettered on the truck itself, in letters at least two inches tall, so compliance is something a roadside inspector can check on sight.

File your Pennsylvania LLC in 7 steps

1
STEP 1 OF 7

Choose and search your business name

Your name must include "Company," "Limited," "Limited Liability Company," or an accepted abbreviation like "LLC," and be distinguishable from names already on file. Search existing Pennsylvania entities through the Business Filing Services search before you file.

2
STEP 2 OF 7

Set your registered office

Pennsylvania requires a registered office, a street address in the state where legal papers can be delivered, rather than a named registered agent. You can list your own Pennsylvania address, which becomes part of the public record, or contract with a commercial registered office provider (CROP) that lists its address instead.

3
STEP 3 OF 7

File the Certificate of Organization (DSCB:15-8821)

Business Filing Services lists the Certificate of Organization (Limited Liability Company) under Initial Forms; filing it online continues behind a Login. The fee is $125 by card. The Department of State's guidance says to allow up to 15 business days for processing, and online is the fastest channel.

STEP 4 OF 7

Get a free EIN from the IRS

Apply for an Employer Identification Number on the IRS website once the LLC is approved. It is free and takes about ten minutes online; you need it for banking, hiring, and taxes. Ignore any site that charges for an EIN.

5
STEP 5 OF 7

Create an operating agreement

Pennsylvania does not require an operating agreement, but banks and partners ask for one and it settles ownership questions in writing. A single-member LLC can use a short standard agreement; multi-member LLCs should document splits and exit terms.

6
STEP 6 OF 7

Check licenses and local permits

Pennsylvania has no general statewide business license. Cities run their own systems; Philadelphia, for example, requires a commercial activity license before a business operates there. For trucking specifically: an intrastate property carrier needs a Certificate of Public Convenience from the Pennsylvania Public Utility Commission, a $100 filing fee plus a safety fitness review, before hauling loads that start and end in the state. Operating without it carries a fine of up to $1,000 per violation, and the carrier's PUC number must be lettered on the truck in letters at least two inches tall.

7
STEP 7 OF 7

Calendar the September 30 annual report and open a bank account

Pennsylvania LLCs file an annual report with a $7 fee, due September 30 each year. The requirement started in 2025 and replaced the old ten-year report, so many existing owners have never filed one. Open a dedicated business bank account with your filed certificate and EIN.

File it yourself, or have it done

Same state fee either way. The difference is your time, and whose address goes on the public record.

Common questions

What is Pennsylvania's Certificate of Public Convenience for trucking?

State authority from the Public Utility Commission, required before an intrastate property carrier hauls loads that start and end in Pennsylvania. It costs $100 to file plus a safety fitness review, and operating without it carries a fine of up to $1,000 per violation.

How is a Pennsylvania trucking company's PUC number displayed?

The PUC certificate number has to be lettered on the truck itself, in letters at least two inches tall, so a roadside inspector can confirm authority on sight. It's separate from the federal USDOT number, which also must be displayed.

Does Pennsylvania have an annual report?

Yes, since 2025. Pennsylvania replaced its old decennial report with an annual report due September 30 each year; the LLC fee is $7. The first cohort filed in 2025, so plenty of owners formed earlier have never seen the requirement. Missing it can eventually cost the LLC its good standing.

Do I need a registered agent in Pennsylvania?

Pennsylvania words it differently: the requirement is a registered office, a Pennsylvania street address where legal papers can be delivered, not a named agent. Your own address works and becomes public record. A commercial registered office provider (CROP) lists its address instead.
